• These terms and conditions do not affect your statutory rights as a consumer. The Terms and conditions may change from time to time. Use of services after any changes will subject you to the new terms.
• IF YOU DO NOT AGREE TO THESE TERMS DO NOT USE THE SERVICE, AS VIOLATION OF THE TERMS CAN LEAD TO LEGAL LIABILITY.
• These Terms and Conditions are applicable to this and certain other AutoWeb Solutions Ltd affiliated sites, but not necessarily all AutoWeb Solutions sites, for which special terms and conditions may apply as indicated. All sites of AutoWeb Solutions Ltd to which this Policy is applicable are collectively referred to as "we", "us", "our" and "AutoWeb Solutions". All references to the customer will be referred to as "you", "customer" or "client". Note that special use terms, or site or page specific terms (referred to as "special terms"), may apply to certain pages/services on this site, but the applicability of any such special terms will be expressly indicated. In the event of any inconsistency between any special terms and this Policy, the applicable special terms will prevail over the terms of this Policy.
• AutoWeb Solutions offers a wide range of e-services. Website designs are provided by skilled and qualified web designers from around the world. Based in the UK we operate globally with a wide range of additional services. The information on our sites is only for your general information and use and may not address your particular individual requirements.
• We record visitors IP address, host name and ISP and user agent data via PHP script to comply with international anti-spamming policies and the Data Protection Act.

• We accept payment via standing order or by the following, PayPal ( 2.5% PayPal surcharge, 4% currency exchange is fully paid by AutoWeb Solutions), Bank transfers, Personal cheques, all major credit and debit cards (via PayPal). We apologise but are unable to accept either American express or Diners club for payment.
• Unless agreed otherwise or where agreed in a monthly payment plan, a minimum of 30% of the total agreed price is required to be paid as a deposit in advance of any work commencing.
• All prices are exclusive of Value Added Tax (VAT) which is chargeable at the current rate at the time of invoicing.
• Once you select your choice of package or specified details, unless otherwise agreed, 30% of the package/agreed price must be paid immediately at which point you have entered into a binding contract with us. Upon completion of the chosen package, an invoice for the outstanding amount will be emailed to the client. The full outstanding balance must be paid within 10 days of the invoice date. Upon receipt of full payment, all necessary information (passwords etc) and/or a CD-Rom will be sent by recorded delivery to your address provided. At this point ownership of the copyright is transferred to you.
• In a case of bespoke development, full project price and payment scheme is described in official proposal which has priority over those rules.
• Where an agreed monthly payment plan is in place, the payments must be made regularly by standing order arrangement each and every month until the end of the agreed period. The first payment being due no later than 30 days after the date of the agreement.
• Ownership of the website shall not pass to the client until the final payment has been made.
• Should the client terminate the agreement, any amounts outstanding in the agreement shall become immediately due and payable to AutoWeb Solutions.
• No interest charges are liable as long as the monthly payments are made when due.
Packages:
• We have put together a selection of main packages. (See item description for full details)
It is your responsibility to ensure the package meets your requirements prior to purchase. As we only sell custom built packages, no refund will be provided for customer error. AutoWeb Solutions may at their discretion offer an alternative package. In case of interest or for more information on a product please contact us. By purchasing a package you accept responsibility for providing the necessary picture material and basic texting/wording for the site.
• At the beginning of creating the package or during the process, changes may be requested by you. You are permitted to make reasonable changes of design and of the site content and changes on the web site within the agreed amount to be paid for the project.
Further amendments are subject of extra cost. If the changes requested do incur costs, the amount will be agreed with you and followed up with email written confirmation. At this point the outstanding balance of the initial package must be paid in full. Charges for requested changes must be paid in full within 7 working days of the invoice for costs of changes being sent to you. After finishing your project and receiving full payment your 1 month's free support is activated. This includes only minor code alterations. Design faults, changes to design layout or errors proven to be the responsibility of AutoWeb Solutions would be dealt with in the normal manner. However faults, errors or changes by you the customer may result in extra costs above the original agreed amount. These would be discussed fully with you and confirmed in writing along with an invoice before further work is carried out by us.
• We offer a full supportive consultation service. Standard service charges may apply.
• AutoWeb Solutions also offers various levels of maintenance services which can be arranged for an additional cost.
• If you decide to cancel an order for web designs within 48hrs of ordering you will receive a full refund. No refund will be offered for cancellations after 48hrs due to the amount of technical work that will have been carried out by this time. Without incurring new costs we are unable to accept responsibility for customers changing design layout after 5 days from purchasing or starting on a project. Events outside the control of both parties may be taken into account at the time of requesting a refund.
• The customer must supply all necessary text and picture materials unless agreed otherwise. If the text is in paper form then extra charge may apply for typing into digital form. Pictures or photographs can be scanned for no extra cost. AutoWeb Solutions cannot be held responsible for material which is delayed, incorrect or not supplied.
If you choose to provide text material yourself, it must be supplied within 3 days from date starting the project. Our Content Writing Service is an optional extra that is available.
• Web design is copyrighted by AutoWeb Solutions. The customer is entitled to all materials created during custom development. We post all materials to customers on a “presentation” CD-Rom free of charge (worldwide). In the case of re-sending then standard service charges apply. AutoWeb Solutions will retain ownership of the all product supplied until full payment is received, either on delivery or within the agreed period.
AutoWeb Solutions accepts no responsibility for any content or materials supplied by a third party to be added to the created website unless prior written agreement has been given by us. Once ownership of a created site has been passed from AutoWeb Solutions to the customer as described above, we will accept no liability for the content, materials, products or descriptions thereof found on the created website.
• Every effort is taken to ensure that within the rules of coding your site is optimised to the maximum level. However, under no circumstances can this guarantee your entry level by a search engine. AutoWeb Solutions have no authority over any search engine and therefore no control over where your site appears on general searches. We fully and accurately apply our own exacting optimisation techniques to ensure the best possible location within search engines but with millions of users all wanting the same top positions this is obviously impossible. Customers who purchase our Internet Promotion Plan will improve their location further in accordance with the rules set by how search engines promote sites. Search engines are organic in their operation and therefore it is vital that your site is optimised for search engines so as the search engine changes it search criteria, your site will always remain correctly coded and will still be fully picked up in searches.
• The final design may differ slightly from the original layout drawings as certain areas of design may not be 100% transferable to XHTML. We will endeavour to match the look of the web site to your ideal design using modern available technology.
• We do not test or guarantee sites using RC releases or Beta versions of browsers as these are incomplete products and are in a phase of testing in the development. We only test using OFFICIAL browser releases. We do test all our web sites to ensure they display properly in all major browsers. XHTML design may not work in older browser types such as IE 5 and below.
• Work accreditation: AutoWeb Solutions reserves the right to add its “designed by” or similar work accreditation to your site in such a way that it does not stand out into a focus field or is interfering. Removing this digital signature is subject to release fee.
• If you supply us with a logo or other picture materials to use on your site, it is your responsibility to ensure you have obtained the necessary rights to those materials. Any claims by a third party or costs incurred in using your own picture materials, will be at your own liability and cost; we accept no ownership of this matter.
• We value our clients and may offer free hosting for certain periods of time. Please always see our promotions. At other times this service is chargeable. Hosting is billed annually unless included in a monthly package, and customers are notified prior to the expiration period in order to renew their services. Your web site does NOT include hosting by default. If you fail to pay your hosting package in time, your hosting may be deleted and will be subject to a minimum £40 administration fee to restore the package on our system. Free hosting is only applicable to completed and fully paid projects. You are not eligible for free hosting if you cancel a project, this will automatically be cancelled without notice. Likewise any form of abuse by you, written, verbal or otherwise, either directly or indirectly to us will result in your hosting being cancelled and your site or sites being suspended or even cancelled. AutoWeb Solutions takes no responsibility for Open source programs of any kind. Those are not developed by AutoWeb Solutions and therefore come with no technical support or consultation help services. We accept no liability for any problems you may have using such a service. A CMS of your choice may be installed onto the server free of charge however AutoWeb Solutions must provide 99.9% hosting service availability.
• Os commerce is an ecommerce type web site that has NOT been designed by AutoWeb Solutions and AutoWeb Solutions accepts no liability for installation of this system or functionality after the original default settings are changed. Unfortunately we are unable to offer technical support for this system. Customizations and installation fees can vary from time to time depending on requirements of the customer. AutoWeb Solutions accepts no responsibility to continue customization following installation or any kind of internet promotion.
• Domain names are registered on your behalf by AutoWeb Solutions. Direct access to a domain by a customer is not permitted and access will not be granted by AutoWeb Solutions. All necessary changes and or transfers will be assisted and set by AutoWeb Solutions. If you at a future point request to purchase the domain name from us, you may be offered the sale at the full market value at the time of asking. No discounts will be offered in respect of purchasing Domain names from us.
• You may at a future date decide to transfer ownership of your site to a third party. You may at your own discretion sell or transfer legal ownership of your website. For legal transfer this needs to be notified in writing to AutoWeb Solutions Ltd listing full details of both parties, date of transfer and any financial arrangement entered into by you and the new owners. Without this documentation, AutoWeb Solutions cannot legally recognise the transfer of ownership.
• You are entitled to suspend development on your project for any reason. A project can be held for a maximum of three months. Projects not commenced again after this time will be deemed closed by AutoWeb Solutions. Customers wishing to activate a project after the three months period will be subject to the new project terms and conditions and any additional costs incurred.
• On rare occasions it may be necessary to temporarily terminate service; this could be for planned maintenance or server upgrades. In this situation we will advise you in advance of the intention. AutoWeb Solutions accept no liability for loss of service for events outside of our control. We will in all circumstances endeavour to restore full service as quickly as possible. No compensation claims will be considered by us in the event of disruptions to service. In circumstances of non payment by you and or abuse by you towards us whether verbal, written or otherwise; we reserve the right to shut down completely any site or server that has been provided. Full payment by you would need to be made as well as any and all charges incurred for this service to be restored.
• This system is monitored to ensure proper operation, to verify the functioning of applicable security features, and for comparable purposes. Anyone using this system expressly consents to such monitoring. Unauthorised attempts to modify any information stored on this system, to defeat or circumvent security features, or to utilise this system for other than its intended purposes are prohibited and may result in criminal prosecution.
• AutoWeb Solutions Ltd make no claims, promises or guarantees about the accuracy, completeness, or adequacy of the contents of this website and expressly disclaims liability for errors and omissions in the contents of this website. No warranty of any kind, implied, expressed or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given with respect to the contents of this website or its hyperlinks to other Internet resources. Reference in this website to any specific commercial products, processes, or services, or the use of any trade, firm or corporation name is for the information and convenience of the public, and does not constitute endorsement, recommendation, or favouring by us.
• AutoWeb Solutions at all times reserves the right to disclose any information as AutoWeb Solutions deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, at the sole discretion of AutoWeb Solutions.
You agree that AutoWeb Solutions, at its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any Content within the Service if you violate these terms. Any form of abuse by you, whether verbal, written or otherwise towards AutoWeb Solutions or its subsidiaries and staff will be taken seriously. AutoWeb Solutions will report such actions to the local authorities and will prosecute any such violation to the full extent of the law.
• AutoWeb Solutions Ltd adheres to both the distance selling regulations 2000 and the Privacy and Electronic Communications (EC Directive) Regulations act 2003. Electronic mail is emails, SMS (text), picture, video and answer-phone messages. Electronic mail marketing messages may be sent to you if we have obtained your details through a sale or negotiations for a sale. If at any point you do not wish to receive these communications, simply advise us in writing, email or by phone and we will remove your details from our mailing list without bias. We do not carry out marketing via Telesales, Automated calls or faxes.
• You the consumer normally have a cooling-off period of seven working days. However as the products are made to a consumer's specification and are goods that cannot, by their nature, be returned then the 7 days cancellation period is not applicable under law. As we supply services that begin, by agreement, before the end of the cancellation period and have duly informed you before the conclusion of the contract, in writing or another durable medium, that you will not be able to cancel once performance of the services has begun with his agreement, we are not enforced by law to provide the cooling off period. With any purchase from AutoWeb Solutions Ltd, a 50% non-refundable deposit is payable. By proceeding with a purchase and supplying payment of the non-refundable deposit you by definition waiver your right to cancellation and agree and accept the Terms and conditions of this site.
